Lawyer Serhiy Vlasenko says he will appeal the decision by the Kyivsky District Court of Kharkiv restricting the amount of time Yulia Tymoshenko has to review the materials in the case involving United Energy Systems of Ukraine, according to the Official web site of Yulia Tymoshenko.

"The appeal will be filed on Monday. We have three days according to the requirements of the Code of Criminal Procedure," Serhiy Vlasenko said at a briefing today in Kharkiv.

He also said he only obtained a copy of the court order in the evening of February 9. "The resolution isn’t based on facts. As always, the court and Security Service of Ukraine twisted the facts and circumstances. That’s exactly why they didn’t want to see the defense in the courtroom. That’s why they informed the defense about the matter only at the beginning of the court hearing," he said.

Serhiy Vlasenko stressed that Yulia Tymoshenko and her lawyers did not refuse to review the case file, as the court claimed. "I always informed the investigator about valid reasons why I couldn’t be at the Kachanivska prison. During the time I was away on business, I asked the investigator to allow my assistant to copy the case materials and was given verbal permission, but a day later I received a written refusal. That’s how they’re manipulating and falsifying the case file," he said.

On February 9, the Kyivsky District Court of Kharkiv granted the SBU investigator’s request to give Yulia Tymoshenko only until March 28 to review the case file. The hearing took place without Yulia Tymoshenko or her lawyers.
